the case was supposedly finally being resolved with a mutually agreed sum to clear the “misunderstandings” - but, of course, in their characteristic weasel manner they screwed me around - the contract they expected me to sign stunk badly! - totally self-serving without any consideration for me - in short: YOU (trevor brown) have been paid, WE (crystal castles) can do whatever we like with your artwork (black eye madonna), and YOU are responsible for any legal repurcussions due to our use of it, thank you, sign here please! - needless to say this was unacceptable to me - i asked for the contract to be redrafted but they would not comply, instead preferring to argue about it in (professional) retarded fashion:
it cannot be rewritten when it is already there. what do you want me to do?
huh? - can anyone not understand now why i am giving up with this?! - a normal intelligent dialogue is impossible! - and all the time they accuse me of being immature blah blah
so, for the record, the three contract points i’m unhappy about in more detail:
For the sum of [$$$], the receipt and sufficiency of which is hereby acknowledged, I, Trevor Brown, hereby irrevocably assign all right, title and interest in and to the artwork that I have created, to the musical group professionally known as “Crystal Castles”
altho they’ve had my bank details for a money transfer for days, no payment has been made - i cannot acknowledge receipt of something i haven’t received - they want me to believe the above is legalese for the contract not coming into effect until payment made - perhaps i’m unable to read properly and am being really stupid here???
Crystal Castles shall have the absolute right to deal with or use, or to refrain from using, the Artwork in any form, in any medium and for any purpose whatsoever which Crystal Castles in its sole discretion may choose, without notification or approval by Artist, and without additional consideration to Artist. Without limiting the generality of the foregoing, Crystal Castles shall have the right to: a) crop, alter, stylize and/or title the Artwork; b) publish the Artwork, or refrain from publishing the Artwork, in any media presently known or hereafter known; and c) secure copyright of the Artwork anywhere in the world. Crystal Castles may assign, license, or otherwise dispose of any of these rights in whole or in part, in its sole discretion.
wtf! - the above constitutes unconditional rights - this was offered to them but, after first agreeing to my fee for this, they (typically) pranced about and changed their minds, wanting a much smaller fee just to clear all that has transpired to date, with no continued rights in the image - the above in no way reflects what was agreed - i received no response back regarding this point
Artist has secured written right-of-privacy releases from any person depicted in the Artwork, where applicable, and that all such releases are attached hereto and made a part of this agreement; and,
Artist will hold Crystal Castles harmless from any and all claims arising therefrom and/or any breach of Artist’s representations herein.
ha! - quite clearly these have been written into the contract due to the fact it’s a depiction of madonna and they do not want to take any legal responsibility for their own actions themselves - any trouble and it’s: “trevor’s fault, not ours” - lame cowards! - i asked for the clauses to be scrapped - impossible to comply with anyway as madonna doesn’t reply to me - response to this was:
well,…whether it is written into the contract or not, this is a license fee and agreement for your image. if we both sign on this and compensate you,…you have earned from the use of her likeness, even if it is retroactive compensation. it goes without saying basically.
not exactly! - my fee is a penalty fee for copyright violation - and not a cut from their illegal activities - trying to incriminate me for their own actions is despicable
so that’s it - i’ve had more than enough of their endless pathetic bullshit now - a leopard cannot change it’s spots - once a criminal, always a criminal - i’d like to get back on with my own happy life now - i want out of the sewer - i don’t want or need any association with crystal castles (and their “talent”)! - they have proved themselves unscrupulous thieves, liars and assholes - their shit-for-brains fans are also a liability - generally trevor brown fans are of above-average intelligence - but crystal castles fans, with few exceptions, are typically young, arrogant, aggressive and stupid (adequately demonstrated by their comments on my blog here) - they already believe stealing is cool - and arguably likely to have a similar lack of morals regarding progression to more serious crimes - then if one of these dolts gets apprehended for assaulting (raping?, killing?) a girl and is found with a collection of trevor brown books, how does that bode for me?! - this has always been one of my wife’s worst fears - so NO THANK YOU!!!
